1. Acceptance of Terms

By accessing or using InstaRadar ("the Service"), available at https://instaradar.app/ ("the Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and InstaRadar ("we," "us," "our").

2. Description of Service

InstaRadar is a web-based platform that allows users to:

View Instagram stories, posts, reels, highlights, and profile pictures anonymously
Download Instagram content for personal use
Track Instagram follower and following changes (Premium feature)
Receive activity alerts for monitored profiles (Premium feature)

The Service accesses only publicly available Instagram information and does not require users to provide their Instagram credentials.

3. Eligibility

You must be at least 16 years old to use the Service. If you are under 18, you must have permission from a parent or guardian to use the Service.

By using the Service, you represent and warrant that you meet these eligibility requirements.

4. Account Registration

Free Access

The Service may be used without creating an account for basic viewing features.

Premium Account

To access Premium features (tracking, alerts, history), you must create an account by providing:

Email address
Password (or authenticate via Google OAuth)
Payment information (processed securely by our payment provider)

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use of your account

5. Acceptable Use Policy

You agree NOT to use the Service to:

Prohibited Activities:

Harass, stalk, threaten, or harm any person
Violate Instagram's Terms of Service or Community Guidelines
Violate any applicable laws or regulations
Infringe on intellectual property rights
Engage in any form of automated access (bots, scraping, crawling) without authorization
Attempt to gain unauthorized access to our systems or other users' accounts
Distribute malware, viruses, or harmful code
Interfere with or disrupt the Service or servers
Impersonate any person or entity
Use the Service for any commercial purpose without our written permission
Share or resell your Premium account credentials
Collect or harvest information about other users
Use the Service in any way that could damage our reputation or business

Content Restrictions:

Do not use the Service to view, download, or share content that violates Instagram's policies
Do not use downloaded content for commercial purposes without proper authorization
Respect the intellectual property rights of content creators

We reserve the right to investigate and take appropriate action against anyone who violates this Acceptable Use Policy, including suspending or terminating accounts without notice.

6. Premium Subscription Terms

Subscription Plans

Premium features are available through paid subscription plans with various billing cycles (monthly, annually, or other periods as offered).

Pricing

Current pricing is displayed on our Site. We reserve the right to change pricing with 30 days' notice to existing subscribers. Price changes will not affect your current billing cycle.

Payment

Payment is processed through our third-party payment provider (Stripe). You authorize us to charge your payment method for all fees incurred under your account.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You will be charged the then-current subscription rate.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at supportatinstaradar.app. Cancellation will take effect at the end of your current billing period. You will retain access to Premium features until the end of your paid period.

Refunds

We offer a 14-day money-back guarantee for new subscribers. If you are not satisfied with the Service, you may request a full refund within 14 days of your initial purchase by contacting us at supportatinstaradar.app.

After 14 days, no refunds will be provided for:

Partial billing periods
Unused Premium features
Voluntary cancellations

Refunds may be provided at our discretion in cases of:

Service outages or technical issues that prevent use of Premium features
Billing errors
Other exceptional circumstances

Failed Payments

If payment fails, we will attempt to notify you and retry the payment. If payment continues to fail, your Premium subscription may be suspended or canceled.

7. Service Availability and Modifications

No Guarantee of Availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee that:

The Service will be uninterrupted, secure, or error-free
Instagram data will always be available or accurate
Any specific features will always be available
The Service will meet your specific requirements

Service Modifications

We reserve the right to:

Modify, suspend, or discontinue any part of the Service at any time
Change features, functionality, or availability
Implement usage limits or restrictions
Update these Terms with reasonable notice

We will make reasonable efforts to notify users of significant changes, but we are not obligated to do so.

Instagram Changes

The Service depends on accessing publicly available Instagram data. If Instagram changes its platform, policies, or technical architecture in ways that affect our ability to provide the Service, we may need to modify or discontinue features without liability to users.

8. Intellectual Property Rights

Our Rights

InstaRadar, including the Site, Service, software, designs, graphics, text, and other content (excluding Instagram content), is owned by us and protected by intellectual property laws.

You may not:

Copy, modify, distribute, sell, or lease any part of our Service
Reverse engineer or attempt to extract source code
Use our trademarks, logos, or branding without permission

Instagram Content

All Instagram content (posts, stories, profile pictures, etc.) displayed through the Service is owned by the respective Instagram users and Meta Platforms Inc. We do not claim ownership of any Instagram content.

By using the Service, you agree to respect the intellectual property rights of content creators.

User Content

Any feedback, suggestions, or other content you provide to us may be used by us without any obligation to you.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR RELIABILITY OF INFORMATION
UNINTERRUPTED OR ERROR-FREE OPERATION

We do not warrant that:

The Service will meet your expectations
Instagram data will be accurate, complete, or current
Defects will be corrected
The Service is free from viruses or harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSTARADAR SHALL NOT BE LIABLE FOR:

INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF PROFITS, REVENUE, DATA, OR USE
SERVICE INTERRUPTIONS OR UNAVAILABILITY
UNAUTHORIZED ACCESS TO YOUR DATA
ERRORS OR INACCURACIES IN CONTENT
ANY DAMAGES RESULTING FROM YOUR USE OF THE SERVICE

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

Some jurisdictions do not allow the limitation of certain damages, so some limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless InstaRadar, its officers, employees, and service providers from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any rights of another person or entity
Your violation of any applicable laws or regulations
Content you view, download, or share through the Service

12. Third-Party Services and Links

The Service may contain links to third-party websites, services, or resources. We are not responsible for:

The availability, accuracy, or content of third-party services
Third-party privacy practices or terms of service
Any transactions or interactions you have with third parties

13. Disclaimer Regarding Instagram

IMPORTANT: InstaRadar is NOT affiliated with, endorsed by, authorized by, or in any way officially connected with Instagram, Meta Platforms Inc., or any of its subsidiaries or affiliates.

The official Instagram website is instagram.com.

We access only publicly available Instagram data and do not:

Store Instagram credentials
Directly integrate with Instagram's API
Violate Instagram's Terms of Service (to the best of our knowledge)

However:

Instagram may change its policies or take action against services like ours
You are responsible for ensuring your use complies with Instagram's Terms of Service
We are not liable for any consequences resulting from Instagram's actions or policy changes

14. Termination

By You

You may stop using the Service at any time. If you have a Premium account, you may cancel your subscription as described in Section 6.

By Us

We may suspend or terminate your access to the Service immediately, without notice, for:

Violation of these Terms
Violation of our Acceptable Use Policy
Fraudulent, abusive, or illegal activity
Non-payment of fees (for Premium users)
Any other reason at our sole discretion

Upon termination:

Your right to use the Service ends immediately
We may delete your account and data
Paid fees are non-refundable (except as provided in Section 6)
Sections of these Terms that should survive termination will remain in effect

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through:

Informal Resolution: First, contact us at supportatinstaradar.app to attempt to resolve the issue informally.
Binding Arbitration (if informal resolution fails): Disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court. Arbitration will be conducted in Delaware or remotely.
Exceptions: Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to systems.

Class Action Waiver

You agree to bring claims only in your individual capacity and not as part of any class or representative action. Class arbitrations, class actions, and consolidation with other arbitrations are not permitted.

16. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and InstaRadar regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

Posting the updated Terms on the Site with a new "Effective Date"
Sending an email to registered users (for material changes)
Displaying a prominent notice on the Service

Continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

By using InstaRadar, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
